Catering & Events Terms & Conditions

These Terms and Conditions (“Terms”) govern the relationship between Kenny Hills Hospitality Group ("we," "us," or "our") and the client (“you” or “your”) for catering and event services. By booking our services, you agree to these Terms, which comply with relevant Malaysian laws and regulations.

1. Booking and Confirmation

  1. All bookings are subject to availability.

  2. A signed invoice and full payment are required to confirm your booking.

  3. We reserve the right to decline any booking at our discretion, in line with local regulations.

 2. Deposits and Payments

  1. Full payment is required 14 days prior to the event date.

  2. Additional charges incurred during the event (e.g., overtime, extra guests, etc.) will be invoiced after the event and are payable within 7 days.

  3. In compliance with Malaysian consumer protection laws, all prices quoted include applicable taxes such as the Sales and Service Tax (SST), unless stated otherwise.

 3. Cancellations and Refunds

  1. Cancellation charges may apply depending on individual circumstances, which will be reflected in the invoice upon booking confirmation. 

  2. Cancellations must be made in writing.

  3. In the unlikely event that we need to cancel the booking, you will receive a full refund of any payments made.

  4. We comply with Malaysian law, particularly the Consumer Protection (Amendment) Act 2010, ensuring refunds and compensation are in line with fair practice and legal obligations.

 4. Menu and Dietary Requirements

  1. The menu must be finalised no later than 14 days before the event.

  2. We will make reasonable efforts to accommodate dietary restrictions and allergies if notified in advance.

  3. We reserve the right to replace or change the menu from the original request without prior notice due to unforeseen circumstances.

  4. We are not responsible for handling food items from other sources, vendors, or suppliers.

  5. We are not liable for any allergic reactions if dietary requirements were not communicated in writing at least 14 days before the event.

  6. Our services comply with Malaysian food safety and hygiene regulations as enforced by the Ministry of Health (MOH) to ensure high standards in food handling and preparation.

 6. Event Timing, Overtime and Leftover

  1. You are responsible for providing accurate event start and end times.

  2. If the event exceeds the agreed time, overtime charges may apply.

  3. Overtime rates are:

    • Manpower - RM 30/person per hour

    • On Site Chef (for canapes) - RM 100/person per hour (head chef)

    • Chef Assistant - RM 50/person per hour

    • Barista - RM 100/person per hour

  4. In compliance with local employment laws, any overtime involving our staff will be billed in accordance with Malaysian Employment Act 1955 regulations.

  5. We will provide the service of packing leftover food in disposable containers only.

  6. You shall not keep leftover disposable cutlery, paper plates/cup, serviettes, tea bags, coffee beans, milk, and sugar sachets.

 7. Liability and Damage

  1. We are not liable to cater any changes or amendments requested by you less than 5 working days prior to the event’s date.

  2. We will not be held responsible for the food quality or food contamination/poisoning in the event that the food is consumed after the event's end time. 

  3. We are not liable for any injury, loss, or damage to persons or property during the event unless caused by our negligence.

  4. You are responsible for any damages to our equipment or property caused by you, your guests, or your vendors during the event.

  5. Our liability is limited to the scope permitted by Malaysian law, specifically under the Contracts Act 1950, which governs the nature of liability in service contracts.

 8. Force Majeure

  1. We are not liable for any delays or cancellations caused by circumstances beyond our control, such as natural disasters, government restrictions, pandemics, or other emergencies (“Force Majeure”).

  2. In the event of Force Majeure, we will work with you to reschedule the event, subject to availability, and in compliance with relevant Malaysian emergency management laws.

 9. Intellectual Property

  1. Any promotional materials, photographs, or videos taken by our team during the event may be used for marketing purposes unless you notify us in writing otherwise.

  2. We will comply with Malaysian intellectual property laws to ensure fair usage and protection of materials.

 10. Changes to Terms and Conditions

  1. We reserve the right to update these Terms at any time. Any changes will be communicated to you in writing and will not affect confirmed bookings.

 11. Governing Law

  1. These Terms are governed by and construed under the laws of Malaysia. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of Malaysian courts.
